Terms of Service

These Terms of Service ("Terms") govern your access to and use of the WorkoutX service ("Service") provided by WorkoutX ("we", "us", or "our"). By registering an account or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using the WorkoutX, you confirm that you are at least 13 years old, have read and understood these Terms, and agree to be bound by them. If you are using the Service on behalf of a company, you represent that you have authority to bind that company.

2. API Access and Keys

Upon registration, you are issued API keys to access the Service. You are responsible for:

• Keeping your API keys confidential and not sharing them publicly
• All requests made using your API keys
• Notifying us immediately if you believe your key has been compromised
• Not exceeding the request quotas defined by your subscription plan

We reserve the right to revoke API keys that are used in violation of these Terms.

3. Acceptable Use

You agree to use the Service only for lawful purposes. You must NOT:

• Attempt to circumvent rate limits or quotas through any means
• Share, resell, or redistribute API access without written permission
• Use the Service to build a competing API product that redistributes our dataset
• Scrape or cache exercise data in bulk beyond what is needed for your application
• Use the Service for any illegal, harmful, or abusive purpose
• Attempt to reverse engineer, decompile, or extract our underlying dataset

4. Data and Content

The exercise data, GIF animations, and related content provided through the WorkoutX are licensed for use within applications that integrate with our API. You may not:

• Redistribute the exercise dataset as a standalone product
• Remove watermarks from GIFs on Free plan without upgrading your subscription
• Use our GIFs or data to train machine learning models without written consent

5. Subscription Plans and Billing

Some features require a paid subscription. By subscribing:

• You authorize us to charge your payment method on a recurring monthly basis
• Subscriptions automatically renew unless cancelled before the renewal date
• Plan changes take effect at the next billing cycle unless stated otherwise
• Refunds are issued at our discretion for unused periods within 7 days of charge

All payments are processed by Stripe. We do not store payment card information.

6. Free Plan Limitations

Free plan users receive:

• 500 API requests per month
• GIF responses include a "WorkoutX" watermark
• Best-effort support only

We reserve the right to modify free plan limits at any time with 14 days' notice.

7. Service Availability

We strive for high availability but do not guarantee uninterrupted access. We may:

• Perform maintenance with or without advance notice
• Suspend access for accounts in violation of these Terms
• Modify, limit, or discontinue any part of the Service with 30 days' notice

Ultra plan subscribers benefit from our best-effort SLA commitment.

8. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, express or implied. We do not warrant that the exercise data is complete, accurate, or suitable for medical or fitness advice. Always consult a qualified professional before following exercise programs.

9. Limitation of Liability

To the maximum extent permitted by law, WorkoutX shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including loss of data or revenue. Our total liability is limited to the amount you paid us in the 3 months preceding the claim.

10. Termination

We may terminate or suspend your account at any time for violation of these Terms. You may terminate your account at any time via the dashboard or by contacting us. Upon termination, your API keys are revoked and access ceases immediately.

11. Changes to Terms

We may update these Terms periodically. Registered users will be notified via email for material changes. Continued use after the effective date constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the jurisdiction in which WorkoutX is incorporated, without regard to conflict of law provisions.
